Written by one of Canada's leading constitutional scholars, Constitutional Law thoughtfully traces the historical development of Canadian political institutions, the division of powers, and the role of the judiciary, with frequent reference to both classical constitutional theory and to recent cases in Canadian constitutional law. Professor Monahan provides a detailed consideration of many current and emerging legal issues, and clarification where the law may be ambiguous. Finally, he delivers his views on the direction for constitutional evolution. The book also contains two detailed case studies on the division of powers, one dealing with jurisdiction over the environment and the other with jurisdiction over transportation.
About the author
Patrick J. Monahan is professor of law and associate dean at Osgoode Hall Law School, and the author of four books and numerous articles on Canadian Constitutional Law and politics. He advised the Ontario Government throughout the Meech Lake Accord negotiations from 1986 to 1990 and served as an adviser to the Inuit Tapirisat of Canada during the negotiations leading to the Charlottetown Accord. Professor Monahan is a frequent commentator in the national media on legal, constitutional, and political issues.
